Essential Element of Muslim Marriage
A] सक्षम पक्षकार (Competence Parties) –
1) उसने यौनावस्था की आयु (Age of Puberty) प्राप्त कर ली हो।
2) स्वस्थ मस्तिष्क (Sound mind) वाला हो।
3) मुस्लिम (Muslim) हो। be a muslim
📎Age of Puberty➡
📍मुस्लिम विधि में विवाह, मेहर तथा तलाक से संबंधित मामलों में वयस्कता की आयु 18 वर्ष ना होकर योवना अवस्था की आयु अर्थात 15 वर्ष मानी जाती है
📍जब पक्षकार 15 वर्ष की आयु पूरी कर लेते है तो वह विवाह के लिए विधिमान्य सहमति भी दे सकते है।
📍लेकिन अगर कोई 15 वर्ष की आयु (Age of Puberty) प्राप्त न की हो, तो विवाह के लिए उसे अवयस्क (Minor) माना जायेगा, तथा उसकी ओर से उसके अभिभावक विवाह की सहमति दे सकते है।
📍Child Marriage Prohibition Act (1929) के अनुसार - जो बाल-विवाह की प्रथा को रोकने के लिए बनाया गया इसमें पुरुष के लिए न्यूनतम आयु विवाह के लिए 21 वर्ष की गए है। इस अधिनियम (Act) का प्रभाव Muslim Law पर भी पड़ता है।
📎Soundness of Mind➡
📍विवाह सम्पन्न होते समय दोनों पक्षकारो का स्वस्थचित होना आवश्यक है।

📍यदि पति व पत्नी दोनो ही मुस्लिम है तो वहां पर वह किसी भी शाखा के हो वह विवाह विधिमान्य माना जायेगा लेकिन इनके धर्म अलग-अलग होने पर इनका विवाह अंतर्धर्मीय विवाह (Inter religious Marriage) माना जायेगा। अंतर्धर्मीय मुस्लिम विवाह (Inter religious Marriage) के नियम निम्न है-
सुन्नी पुरुष और शिया महिला के मध्य विवाह विधिमान्य विवाह है।
सुन्नी पुरुष और किताबिया महिला के मध्य विवाह विधिमान्य विवाह है।
सुन्नी पुरुष और गैर मुस्लिम अथवा गैर कितबिया महिला के मध्य विवाह अनियमित विवाह है।
शिया पुरुष और किताबिया अथवा गैर किताबिया महिला के मध्य विवाह शून्य विवाह है।
मुस्लिम महिला और गैर मुस्लिम पुरुष के मध्य विवाहशून्य विवाह है।
B] स्वतंत्र सहमति (Free Consent)➡
मुस्लिम विवाह के विधिमान्य होने के लिए पक्षकारो या उनके अभिभावकों की सहमति आवश्यक है पक्षकार यदि वयस्क तथा स्वस्थचित मस्तिष्क वाले है तो उनकी स्वयं की सहमति ही पर्याप्त है | सहमति चाहे स्वयं पक्षकारो की हो या उनके अभिभावको की, स्वतंत्र होनी चाहिये
